Terms of Service

These Terms of Service (hereinafter the “Terms”) set out the terms and conditions under which Vahan Lab EURL makes the SunMap mobile application (hereinafter the “Application” or the “Service”) available to users, together with the rights and obligations of the parties in that context.

Installing and using the Application implies the user’s full and unreserved acceptance of these Terms.

SunMap is a mobile application that displays the position of the sun and the shadows it casts on a map in real time, taking into account terrain, buildings and surrounding vegetation. The Service makes it possible in particular to:

• locate venue terraces (cafés, bars), public benches or picnic tables that are sunlit or shaded;
• anticipate the sun exposure of a place at a given time or date;
• help choose a bivouac spot or assess the exposure of a climbing site.

The map data used by the Application comes from the OpenStreetMap (OSM) project.

4.1 Features without an account — The main use of the Application (viewing sunlight and shadows) does not require creating an account.

4.2 Optional user account — An account is required only to submit reports or contributions to the map. Users may, if they wish, link their OpenStreetMap account so that their reports are sent directly to OpenStreetMap. In that case, use of the OpenStreetMap service is also subject to OpenStreetMap’s own terms of use, which are independent of SunMap.

4.3 Minors — The Application is accessible to minors. Any underage user is advised to use the Application under the supervision of a holder of parental authority, in particular for creating an account or making any purchase within the Application.

4.4 Account deletion — Users may request the deletion of their account at any time. Identification data is then erased, while reports and contributions already submitted to the map are retained and permanently dissociated from their author: they describe the terrain, not the user, and removing them would degrade the service for every user. Details are set out in section 8 of the Privacy Policy.

The Application offers two ways to access paid features:

• an annual subscription, renewed automatically at each expiry unless cancelled by the user before the renewal date;
• a one-time purchase, granting lifetime access to the features concerned.

Payments are processed through the Apple App Store platform and the third-party service RevenueCat, in accordance with their respective terms. Vahan Lab EURL never has access to the user’s banking details.

Subscriptions are managed, changed and cancelled directly from the settings of the user’s Apple account (App Store).

The prices displayed are those in force at the time of purchase and may be changed at any time, without retroactive effect on purchases already made.

The Application provides an estimate of sunlight and cast shadows, computed from map data (terrain, buildings, vegetation) and from solar position models. That data and those models carry margins of error, arising in particular from:

• the accuracy and freshness of OpenStreetMap data;
• features absent from the mapping (recent construction, changing vegetation, temporary furniture, and so on);
• the approximations inherent in any computational model.

Consequently, the information provided by SunMap is a decision aid and may under no circumstances be regarded as an absolute guarantee of actual sun or shade on the ground.

This limitation matters particularly for outdoor uses such as choosing a bivouac spot or assessing the exposure of a climbing site: the user remains solely responsible for checking actual conditions on site before making any decision, especially where their safety may be at stake. Vahan Lab EURL cannot be held liable for the consequences, direct or indirect, of using the Application in a way that does not match the reality of the terrain.

The Application, its code, its design, its trademark and its own content (excluding OpenStreetMap data and user content) are the exclusive property of Vahan Lab EURL. Any unauthorised reproduction, representation or exploitation is prohibited.

Map data from OpenStreetMap remains governed by its own licence (Open Database License — ODbL).

The processing of personal data carried out in connection with use of the Application is described in the Privacy Policy, available at https://sunmap.tech/policy, which forms an integral part of these Terms.

Vahan Lab EURL reserves the right to amend these Terms at any time. Users will be informed of any substantive change by a notification in the Application or by any other appropriate means. Continuing to use the Application after such a change constitutes acceptance of the new Terms.

These Terms are governed by French law. In case of a dispute, and failing amicable resolution, the French courts shall have exclusive jurisdiction, subject to the mandatory provisions applicable to consumers residing in another Member State of the European Union.
